These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “Traveler”) and Travelexie (CYC Enterprises Pvt Ltd) (“Company”, “we”, “us”, “our”) governing the use of our website, services, and all travel bookings. By accessing our website or making any booking, you acknowledge that you have read, understood, and agreed to these Terms.

1. Nature of Service — Intermediary Role

1.1 Travelexie acts solely as a booking agent and facilitator for airlines, hotels, transport operators, visa facilitators, cruise lines, insurance providers, and other service providers (“Suppliers”).

1.2 We do not own, control, or operate these services. The contract for such services is between the traveler and the respective Supplier.

1.3 Supplier terms and conditions shall apply in addition to these Terms.

2. Eligibility & Authority to Book

2.1 Users must be at least 18 years old and legally competent under the Indian Contract Act, 1872.

2.2 The person making the booking warrants that they have authority to accept these Terms on behalf of all travelers.

2.3 The primary traveler shall be responsible for payments, documentation, and communication.

3. Booking & Confirmation

3.1 All bookings are subject to availability and confirmation from Suppliers.

3.2 A booking is confirmed only after:

  • Receipt of required payment
  • Issuance of confirmation voucher/ticket
  • Written confirmation from Travelexie

3.3 We reserve the right to refuse or cancel any booking at our discretion.

4. Pricing & Payment

4.1 Prices are dynamic and subject to change until full payment is received.

4.2 Price changes may occur due to:

  • Currency fluctuations
  • Fuel surcharges
  • Supplier revisions
  • Government taxes/fees
  • System errors

4.3 If a pricing error occurs, we reserve the right to cancel the booking and refund payments received.

4.4 Failure to pay within deadlines may result in cancellation without notice.

5. Passports, Visas & Documentation

5.1 Travelers are solely responsible for obtaining valid travel documents.

5.2 Passport validity must generally be at least six (6) months beyond travel dates.

5.3 Travelexie is not responsible for:

  • Visa refusal or delays
  • Immigration decisions
  • Documentation errors
  • Denied boarding or entry

5.4 No refund shall be provided for losses arising from inadequate documentation.

6. Travel Insurance

6.1 Travel insurance is strongly recommended.

6.2 The Company shall not be liable for medical costs, accidents, emergencies, or losses during travel.

7. Amendments by Customer

7.1 Changes to travel dates, names, or services are subject to Supplier rules and availability.

7.2 Amendment fees and price differences shall be payable by the customer.

7.3 Certain bookings may be non-changeable.

8. Cancellations & Refunds

8.1 Cancellation charges shall apply as per the applicable cancellation policy and Supplier terms.

8.2 Service fees and processing charges are non-refundable unless expressly stated.

8.3 Refunds will be processed only after receipt from Suppliers.

9. Supplier Liability

Travelexie shall not be liable for acts, omissions, or deficiencies of Suppliers, including:

  • Flight delays, cancellations, or schedule changes
  • Hotel overbooking or service issues
  • Transport breakdowns
  • Loss/damage of baggage
  • Strikes or operational failures

10. Cancellation by Travelexie

We may cancel bookings due to:

  • Non-payment or delayed payment
  • Fraud suspicion
  • Safety concerns
  • Supplier failure
  • Force majeure
  • Government restrictions

Refunds or alternatives will be provided based on Supplier policies.

11. Force Majeure

We shall not be liable for failure or delay caused by events beyond our control, including:

  • Natural disasters
  • War, terrorism, civil unrest
  • Epidemics or pandemics
  • Government actions or travel bans
  • Weather disruptions
  • Labor strikes

No compensation shall be payable in such cases.

12. Limitation of Liability

12.1 Our liability, if any, shall be limited to the amount actually paid to us for the specific service.

12.2 We shall not be liable for indirect, incidental, consequential, or special damages, including loss of profits or enjoyment.

13. Traveler Conduct

13.1 Travelers must comply with laws and regulations of destinations.

13.2 Misconduct resulting in fines, penalties, or damages shall be borne by the traveler.

13.3 We reserve the right to terminate services without refund for disruptive behavior.

14. Health & Safety

14.1 Travelers must disclose medical conditions or special needs at booking.

14.2 Failure to disclose may result in denial of services without liability.

15. Data Protection

Personal data shall be processed in accordance with applicable laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act).

16. Intellectual Property

All website content, trademarks, and materials are the property of Travelexie or licensors and protected by law.

17. Website Use

17.1 Users agree not to misuse the website or attempt unauthorized access.

17.2 We are not liable for technical errors, interruptions, or inaccuracies.

18. Fraud Prevention

We reserve the right to verify identity and payment details. Suspicious transactions may be declined or cancelled.

19. Complaints & Claims

19.1 Complaints must be reported immediately during travel.

19.2 Failure to notify may affect the ability to claim compensation.

20. Governing Law & Jurisdiction

20.1 These Terms are governed by the laws of India.

20.2 Subject to the Consumer Protection Act, 2019, courts at Kolkata, West Bengal shall have exclusive jurisdiction.

21. Severability

If any provision is held invalid, the remaining provisions shall remain enforceable.

22. Amendments

We may modify these Terms at any time without prior notice. Continued use constitutes acceptance of updated Terms.

Refund & Cancellation Policy

Effective Date: 24-02-2026

1. Cancellation by Customer

Cancellations must be submitted in writing. Charges apply as follows (land arrangements):

Booking amount or actual supplier charges

25% of total tour cost

15–29 days

50% of total tour cost

7–14 days

75% of total tour cost

Less than 7 days / No-show

100% of total tour cost

Higher charges may apply for peak season, luxury travel, cruises, or promotional fares.

2. Flights

  • Airline rules apply.
  • Many fares are non-refundable.
  • Refunds depend entirely on airline approval.

3. Hotels & Land Services

  • Subject to Supplier cancellation policies.
  • Non-refundable rates cannot be cancelled or amended.

4. Visa & Insurance

All visa fees, service charges, and insurance premiums are strictly non-refundable.

5. Visa Rejection

Visa refusal does not entitle the traveler to a full refund. Applicable cancellation charges will apply.

6. No-Show

Failure to commence travel as scheduled will result in 100% cancellation charges.

7. Amendments

Rescheduling or changes may incur additional costs and are subject to availability.

8. Refund Processing

  • Refunds will be processed only after funds are received from Suppliers.
  • Typical timeframe: 7–45 working days (may extend for international cases).
  • Refunds will be made to the original payment method.

9. Cancellation by Travelexie

If cancellation occurs due to force majeure, supplier failure, or operational reasons:

  • Alternative arrangements may be offered, OR
  • Refund will be processed subject to Supplier refunds

No additional compensation shall be payable.

10. Non-Refundable Charges

The following are generally non-refundable:

  • Service fees
  • Processing charges
  • Payment gateway charges
  • Credit card fees
  • Promotional discounts
  • Convenience fees

11. Force Majeure

No liability for cancellations due to circumstances beyond control. Refunds depend solely on Supplier policies.
